Estate Planning
We make sure your wishes are clear and your family is protected
Our Estates team creates comprehensive estate plans that ensure your assets go where you want them. We handle wills, powers of attorney, enduring guardianship, and estate administration.
Estate planning means protecting your assets, choosing who makes decisions if you can't, and ensuring your family doesn't face unnecessary complications when you die. We work with individuals and families across the ACT and NSW to create clear documentation that provides certainty for the future.
A properly structured will ensures your assets go to the right people, appoints the right executor, and nominates guardians for minor children. Without one, legislation decides, often creating outcomes you would not have chosen. We draft wills that reflect your circumstances, including testamentary trusts and blended-family arrangements, and advise on superannuation death benefit nominations.
An Enduring Power of Attorney authorises people you trust to make decisions about your finances, health care, and personal matters if your capacity declines. We prepare powers of attorney that cover these decision-making areas. If someone has already lost capacity without proper documentation, we guide families through the tribunal process to appoint guardians and financial managers.
Executors need legal authority to deal with estate assets, and administration involves complex obligations across legal, financial, and tax matters. We secure Grants of Probate, handle liaison with financial institutions, and ensure assets are distributed according to the will or intestacy legislation. We work with executors and their accountants from probate through to final distribution.
We act for executors defending estates and for family members pursuing entitlements. This includes challenges to wills, family provision claims by spouses, children, and other eligible people, disputes over testamentary capacity or undue influence, and disagreements about care arrangements during someone's lifetime. We provide clear advice and the path to resolution.
